These Terms of Service ("Terms") govern your access to and use of the Bolder AI Powered Care software (the "Service") provided by Bolder-I LLC d/b/a Bolder AI Care ("Bolder AI Care", "we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service. The Service is offered in and intended for the United States.
The Service helps healthcare staff record, transcribe, and review patient exams and generate supporting documentation such as summaries, SOAP notes, exam findings, and suggested billing codes. Features and availability may change over time.
Transcription runs entirely in your browser. The audio is turned into text on your own device and only the text is uploaded — the recording itself is never sent to Bolder AI Powered Care.
The Service is available to anyone who registers for an account and agrees to these Terms. By using the Service, you represent that you are able to form a binding contract. You are responsible for the accuracy of your registration information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use.
Where an account belongs to an organization, the organization's administrators control membership and role assignment, and may add, suspend, or remove members and reset member credentials. Access to patient information is limited by the role assigned to each member.
Fees for the Service are charged per practitioner. Each practitioner account begins with 7 days of free access, followed by $9.99/month per practitioner for the next 3 months, and $250/month per practitioner thereafter. The 7-day free period runs separately for each practitioner, beginning when that practitioner's account is created or their practitioner role is assigned.
Support staff accounts are included at no additional charge. Accounts assigned an organization administrator, medical assistant, or medical receptionist role do not count toward the number of practitioners billed. Where an account belongs to an organization, the organization is responsible for fees for the practitioner accounts in it.
Fees are billed in USD and are stated exclusive of any taxes, which are your responsibility where applicable. You may cancel at any time; cancellation stops future charges and takes effect at the end of the period already paid for, and amounts already charged are not refunded except where required by law. If we change our fees, we will provide notice before the change applies to you, and continued use after it takes effect will be subject to the updated fees.
You agree to use the Service only for lawful purposes and in compliance with applicable laws and your organization's policies. You must not attempt to access data belonging to other accounts or organizations, disrupt or compromise the Service, reverse engineer it, or upload content you are not authorized to process.
You are responsible for ensuring you have the necessary authorization to record and process any patient information you enter into the Service, and for complying with your obligations under HIPAA and other applicable laws.
Where Bolder AI Care creates, receives, maintains, or transmits protected health information ("PHI") on your behalf and you are a covered entity or business associate under HIPAA, that processing is a business associate relationship and is governed by a written Business Associate Agreement ("BAA") between us. We are prepared to enter into a BAA with covered-entity and business-associate customers; if you do not already have one with us, contact us to put one in place.
Bolder AI Care maintains signed Business Associate Agreements with its own subcontractors and infrastructure providers that may handle PHI on our behalf, including our cloud infrastructure provider, and requires them to apply safeguards consistent with our obligations to you.
Your EMR is the system of record. The official, permanent patient record is maintained by you in your own HIPAA-compliant systems, under your own medical-record retention policy. The deletion described below applies only to temporary copies held by Bolder AI Care and does not affect information already transferred to or incorporated into your medical record system.
Temporary copies of transcripts, medical measurements, generated documentation, and other patient information processed by the Service are deleted from Bolder AI Care-controlled systems within 24 hours after processing and secure delivery to the healthcare provider. You are responsible for exporting or transferring any information that must be retained as part of the medical record before this deletion occurs.
The recording is not part of what Bolder AI Powered Care holds or deletes — it never leaves your browser. What is deleted on that schedule is the text we received: the transcript and the drafted output. Because the recording is held only in the browser that made it, retaining or disposing of it is under your control, and Bolder AI Care cannot produce, restore, or delete it on your behalf.
Where no EMR connection has been configured for your account, there is no delivery target, and temporary copies are instead deleted within 7 days. A longer retention period may be agreed in writing as part of EMR integration. Once an EMR connection is live, the within 24 hours period above applies.
Limited technical records that do not contain patient-record content — including the access log — may be retained beyond these periods when necessary for cybersecurity, system integrity, audit, incident investigation, or compliance purposes.
We are not responsible for information lost due to this automatic deletion if it was not exported or delivered in time. Account information (as distinct from patient and visit information) is retained until your account is deleted.
With separate and affirmative authorization from the relevant patient or authorized party, Bolder AI Care may retain selected information beyond the standard deletion periods described in Section 7 to evaluate, train, test, and improve the quality, safety, accuracy, and reliability of our software, as described in Section 11 of our Privacy Policy. This program is separate from and does not modify the default automatic deletion described in Section 7, and participation is voluntary.
The Service produces automated outputs such as transcripts, summaries, suggested documentation, and suggested billing codes, generated using machine-learning services. These outputs may contain errors or omissions and are provided to assist, not replace, professional judgment. A qualified clinician is responsible for reviewing and verifying all outputs before they are relied upon or entered into the medical record. The Service does not provide medical advice.
We and our licensors own the Service and all related intellectual property. You retain all rights to the data you submit to the Service. You grant us a limited license to process that data solely to provide, secure, and support the Service, consistent with our Privacy Policy and any applicable Business Associate Agreement.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. To the maximum extent permitted by law, Bolder AI Care will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from or related to your use of the Service. Nothing in this section limits either party's obligations under an executed Business Associate Agreement.
You agree to indemnify and hold Bolder AI Care harmless from claims, losses, and expenses arising out of your misuse of the Service, your violation of these Terms, or your processing of information without the necessary authorization, including processing PHI without an executed BAA where one is required.
We may suspend or terminate access to the Service for conduct that violates these Terms or that may harm the Service or others. You may stop using the Service, leave an organization, or close your account at any time.
Closing an account or organization disables access to the Service. Records we are required to retain for medical-record, audit, or legal-compliance purposes are preserved rather than erased, as described in Section 7 and in our Privacy Policy.
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Colorado, and you consent to their jurisdiction.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
